Koloi Ya Goa ("we", "us", "the platform") operates an online auction marketplace connecting private buyers and sellers of motor vehicles in South Africa. We are a venue and introduction service — we are not the seller, buyer, or owner of any vehicle listed.
When you place a bid, you make a legally binding offer to purchase the vehicle at that price. If you are the highest bidder when the auction ends and any reserve is met, you are committed to completing the purchase. Failure to honour a winning bid may result in suspension and forfeiture of any deposit.
Listing is free. A success fee of 2.5% of the final hammer price is payable by the seller on a completed sale. Optional services (e.g. independent inspections) are charged separately and disclosed up front.
We may offer a secure payment-hold facility. Where used, funds are held until the buyer confirms collection of the vehicle. Direct payment between parties is at their own risk. Koloi Ya Goa is not a party to the sale contract between buyer and seller.
To the extent permitted by law, Koloi Ya Goa is not liable for the condition, legality, or roadworthiness of any vehicle, nor for disputes between buyers and sellers. Buyers should inspect vehicles and verify documentation before paying. Nothing in these terms limits your rights under the Consumer Protection Act where it applies.
We may suspend or terminate accounts that breach these terms, engage in fraud, or harm the integrity of the marketplace.
We may update these terms from time to time. Material changes will be communicated, and continued use constitutes acceptance.
These terms are governed by the laws of the Republic of South Africa. Disputes are subject to the jurisdiction of South African courts.
